§1. Service provider
The service is provided by Rockit - Michał Rokicki, ul. Stelmachów 58A/17, 31-341 Kraków, NIP 7171811826 (hereinafter the "Provider"). Contact: kontakt@modwall.dev.
§2. Definitions
- Service — the modwall image moderation API together with the panel and widget.
- Client — an entrepreneur using the Service in the course of their business.
- API key — a confidential token authenticating the Client's requests.
- Score — a numeric probability estimate, not a binding verdict.
§3. Nature and scope of the Service
The Service is a tool that assists content moderation. It returns a probability estimate (score), not a guarantee of correctness. The final decision and the responsibility for content published by the Client remain with the Client.
The Service detects NSFW content (nudity/adult content) and related categories. CSAM material (depicting the sexual abuse of children) is outside the scope of the Service — the Service must not be used to detect or process it. That is a separate, regulated ecosystem based on hash-matching and reporting obligations.
§4. Account and API keys
Use requires an account and acceptance of these Terms. The API key is confidential — the Client is responsible for its security and for the requests made with it. It is prohibited to use the Service in a manner that is unlawful or infringes the rights of third parties.
§5. Plans, limits and payments
Plans are billed on a prepaid basis: a single payment grants access to the plan for the duration of the period (approx. 30 days). Prices in the pricing list are net amounts — value added tax (VAT, 23%) is added to the amount due. Payments are handled by the operator Przelewy24.
Before payment a proforma invoice is issued, and once the payment is
booked — a VAT invoice. Once the plan limit is used up, further requests return
code 402 until the end of the period or until the plan is upgraded. The period does not renew
automatically — before it ends the Provider sends a reminder by email.
§6. Personal data
When processing images on the Client's behalf, the Provider acts as a data processor. We do not store images — we process them in memory and delete them after inference; we log only metadata (time, score, size). Data is processed on infrastructure in the EU. Details in the Privacy Policy; the entrustment is governed by the DPA.
§7. Availability and outages
The Provider makes every effort to ensure continuity of operation but does not guarantee
uninterrupted availability (outside a separately agreed SLA). If the inference engine is unavailable, the API
returns code 503; the Client themselves decides on their fallback behaviour (recommended:
routing the content to manual moderation).
§8. Liability
To the extent permitted by law, the Provider's liability is limited to the amount of fees paid by the Client in the 3 months preceding the event. The Provider is not liable for indirect damages or for the consequences of moderation decisions taken by the Client on the basis of the Service's results.
§9. Complaints
Send complaints to kontakt@modwall.dev; we handle them within 14 days.
§10. Duration and termination
The agreement is in force for as long as the Service is used. The Client may cancel at any time; the unused prepaid period is non-refundable, unless mandatory provisions of law provide otherwise.
§11. Changes to the Terms
The Provider may change the Terms for important reasons, informing the Client in advance. Continued use after the changes take effect constitutes their acceptance.
§12. Final provisions
In matters not regulated herein, Polish law applies. The Service is addressed to entrepreneurs (B2B). Disputes are resolved by the court competent for the Provider's registered seat.
